South African Opposition Argues for Secret Ballot on Zuma Vote

Since President Jacob Zuma's cabinet reshuffle, opposition parties have been pushing for his removal by court action, impeachment and votes of no confidence. If the ballots were secret, however, this would not be a problem.

Justice Mbuyiseli Madlanga told counsel for the UDM‚ Dali Mpofu SC‚ that the drafters of the Constitution in two instances were alive to the need for secret ballot: on the right of citizens to vote by secret ballot (Section 19) and on when the president was appointed (Section 86).

But if MPs want a secret ballot, why can't we just have one, then?
.

South African President Jacob Zuma has publicly endorsed his former wife Nkosazana Dlamini-Zuma to replace him as the ruling African National Congress's president‚ a move that could automatically push her to the State Presidency, observers have said.Zuma's endorsement took place at the St Catherine's Roman Catholic Church in Dlamini-Zuma's birthplace of Bulwer in the KwaZulu-Natal Midlands where they both attended a service on Sunday before joining the congregants of the Abundant Life Church in Durban. It's the fifth one the main opposition party has brought against Zuma.

He also said the people of South Africa wanted Zuma to give back to them the R200 million spent on his Nkandla homestead.

De Vos believes the ConCourt will find that Mbete has the power to decide whether to authorise a secret ballot or not.

It seems likely that the ConCourt will rule that Mbete use her discretion to choose a secret ballot, but whether the ConCourt will order that a secret ballot be used remains unclear - and contentious.

Semenya said UDM had to show that the Constitution requires a secret ballot to be cast in relation to a motion of no confidence in the president.

So where does this leave us? However, this strategy is somewhat self-defeating as it begs the question of whether the vote to suspend the rule would, again, be open or not.

Mpofu argued that National Assembly speaker Baleka Mbete had failed to hold the executive to power after receiving a request to table the motion of confidence in a letter addressed to her in April, as she was obligated to do.

"Surely that must put an obligation on the Speaker simply to do what she can do to prevent that crime from being committed".

Zuma and the ruling African National Congress (ANC) have suffered a string of judicial setbacks and the political stakes are high in this case.

He said ANC MP's should not only stand on podiums, but should "come and vote so that Zuma is removed".
