Worldwide court orders Pakistan to halt execution of alleged Indian spy

The Kulbhushan Jadhav episode has exposed the real face of India to the world for its involvement in terrorism, terror financing, subversion and spying activities in a sovereign state of Pakistan.

Sehwag took to Twitter and wrote "Satyamev Jayate" #KulbhushanJadhav.

"In the annals of worldwide law this judgment is a great victory of the rule of law", he said.

Sehwag advised Pakistan not to thrive on misunderstanding.

The Attorney General office said that Pakistan attended the hearing out of its utmost respect for the court and pursuant to the established jurisprudence that the challenge to jurisdiction can be made via appearance and not by abstaining from the process. It said these measures have no bearing whatsoever on the final decision of the court.

After a huge setback at the International Court of Justice in the Kulbhushan Jadhav case, Pakistan on Thursday said it does not accept the United Nations court's jurisdiction in matters related to national security.

Earlier Sushma Swaraj while reacting on the order said, "The ICJ order has come as a great relief to the family of Kulbhushan Jadhav and people of India".

At hearings Monday, Indian lawyers maintained Pakistan had violated the 1963 Vienna Convention on Consular Relations.

Amid the court proceedings in the Kulbhushan Jadhav case, President of the ICJ, Ronny Abraham said that India should have been given consular access as per Vienna convention.

The court heard the accused was a serving officer in the Indian Navy and had been allegedly involved in carrying out espionage and sabotage in Pakistan's port city of Karachi and Balochistan province. A Pakistani lawyer added that a bilateral agreement allows either country to make decisions on consular access in cases involving politics or security.

The two countries are battling it out in the worldwide court amid a sharp escalation in tension over ceasefire violations by Pakistan, terror attacks in Jammu and Kashmir and the recent mutilation of two Indian soldiers by Pakistanis.

"The government of India must use the ICJ decision as a trigger to bring Kulbhushan Jadhav back. As for Jadhav he should be provided a fair trial regardless", he said.

"This order creates legally binding global obligation", he said.
