Senior Bureaucrat and adviser to Prime Minister on Foreign Affairs Sartaj Aziz said on Saturday that the International Court of Justice can not annul the death penalty of Kulbhushan Jhadav given by Pakistan's military court. He said the ICJ had a tradition of ruling against death penalty.

Pakistan's Attorney General Ashtar Ausaf Ali will plead Pakistan's case at the International Court of Justice against Jadhav, sources said.

Pakistan had earlier said that ICJ has no jurisdiction in matters of national security.

Asked about the reported refusal of Pakistan Foreign Office to accept the ICJ order, Jaitley said it would amount to Pakistan violating the cannons of global norms.

They subsequently approached the International Court of Justice and accused Islamabad of not providing consular access to Jadhav - which contravenes Article 36 of the Vienna Protocol. "This has been a matter of concern".

The adviser said that the ICJ has not issued any order with regard to consular access to Kulbhushan Jadhav.

If the ICJ upholds the Indian point of view, Pakistan would find itself facing a very hard choice - the humiliation of allowing access to Jadhav or worldwide opprobrium if he is hanged.

"Jadhav has been sentenced to death in accordance with the constitution of Pakistan because he was arrested in the country", Nisar said.

The ICJ rejected Pakistan's stance and stated that the court had jurisdiction and would hear the case and seek arguments from both parties. By comparison, Kasab's arrest, trial, appeals and eventual hanging - through the Bombay high court and then the Supreme Court - took as long as four years. My own opinion is that it was a serious mistake for India to go to the ICJ on this issue.
