US President Donald Trump says travel ban ruling comes at 'dangerous time'

The high court is considering the administration's request and could act before the justices wind up their work at the end of June. Theoretically, the Supreme Court could interpret the clock as having started when the administration was allowed to begin developing new visa procedures for citizens of those countries.

The judges added the government had failed to prove "any link between an individual's nationality and their propensity to commit terrorism", and cited a 5 June tweet by Trump to back their argument.

The Supreme Court gave opponents of the travel ban until June 12 to respond to the government's request to allow immediate implementation of the executive order.

In January, Trump had issued his initial travel ban, bringing chaos and protests to airports around the country.

On Monday, the 9th U.S. Circuit Court of Appeals upheld the injunction secured against the immigration ban in March in a federal district court in Hawaii.

In addition to banning travelers from six mostly Muslim nations for 90 days, Trump's executive order called for a suspension of the nation's refugee program. The court also found that the president's order ran afoul of an immigration law that prohibits discrimination on the basis of nationality.




"It provides a very attractive way to leave the injunction in place without setting broader doctrinal rules about which they may have pause", Vladeck said.

According to the decision that law "requires that the President exercise his authority only after meeting the precondition of finding that entry of an alien or class of aliens would be detrimental to the interests of the United States". The Justice Department had argued that it felt blocked from conducting such a review by the Hawaii judge, meaning the clock had essentially stopped.

What sparked the release of Trump's wrath is the fact that the 9th United States Circuit Court unanimously upheld the decision to block his revised travel ban.

The state of Hawaii and Ismail Elshikh, the imam of the Muslim Assn. of Hawaii, argued that Trump's order stigmatized Muslims and would hurt tourism and the recruitment of university students and faculty.

If a stay is granted and the travel ban goes into effect this summer, the 90 and 120-day periods could expire or come close to expiring by October, which would also make the case moot before the Supreme Court can ultimately rule on the ban's constitutionality. The March order was meant to overcome the legal issues posed by the original ban, but was blocked before it could go into effect on March 16. The court noticed that even the federal officials were skeptical how effectual the first executive order might prove. "S.C.", Trump posted on the social messaging site. The appeals court, which also ruled against Trump's first travel ban in February, concluded that his own statements made clear that the revised version contains the same flaw by targeting Muslims.
