'Making a Murderer' Confession Was Coerced, Judges Affirm

A federal appeals panel affirmed on Thursday an earlier ruling that the confession of Brendan Dassey, featured in the Netflix series "Making a Murderer", was made under coercion and that he should be released from prison, The Associated Press reported.

November 8, 2005: Avery tells reporters he fears authorities are trying to frame him for Halbach's slaying because he sued Manitowoc County officials for $36 million for wrongful conviction.

A federal magistrate judge ruled in August that investigators coerced Dassey at the time he confessed and suffered from cognitive problems. However, Attorney General Brad Schimel quickly chimed in, stating that the "U.S. Court of Appeals for the Seventh Circuit granted the State of Wisconsin's motion to stay U.S. Magistrate Judge William Duffin's order to release Mr. Brendan Dassey".

Dassey is represented by attorneys Laura Nirider and Steven Drizen of the Center on Wrongful Convictions of Youth.

"We are evaluating the 2-1 decision from the court", Johnny Koremenos, the communications director for the Wisconsin Department of Justice, said in a statement on Thursday.

"The decision of the district court is AFFIRMED, with costs, in all respects".

The 7th Circuit Court of Appeals heard oral arguments in February as to whether Dassey's confession should stand. Avery was sentenced to life in a separate trial.

During Dassey's interrogation, investigators can be seen feeding him information and leading him to give the answers they were looking for regarding the murder of Teresa Halbach.




Avery trial attorney Jerry Buting tweeted, "Hurrah!"

Dassey, now 27, was convicted of first-degree intentional homicide, second-degree sexual assault, and mutilation of a corpse in Halbach's killing.

The state of Wisconsin argues that detectives did nothing wrong. He also overturned Dassey's conviction, granting Dassey's writ for petition of habeas corpus and finding that his imprisonment was unlawful.

Avery, 54, is serving a life sentence at a Wisconsin prison.

The case was the subject of the 10-part documentary "Making a Murderer", which questioned the handling of the investigation and the motives of Manitowoc County law enforcement officials.

However, the state can still appeal to the U.S. Supreme Court or retry Dassey.

Attorney Berg: "Brendan Dassey chose to confess, to release those awful images of Teresa Halbach that were haunting him". If a police officer says to someone who's being interrogated, "let's get it all out today, and this will be all over"...
