Rajesh, Nupur Talwar acquitted, to walk out of Dasna jail tomorrow

The Allahabad High Court on Thursday acquitted Nupur and Rajesh Talwar in the 2008 murder case of their 14-year-old daughter Aarushi and domestic help Hemraj, saying they could not be held guilty as per the circumstances and the evidence on record.

The Allahabad High Court has overturned a CBI court verdict in the sensational Aarushi Talwar murder case, acquitting her dentist.

Stating that the basic legal tenet was that an accused is innocent until proven guilty, the judges said: "The CBI has not provided the court with evidences that prove beyond doubt that they were guilty". The needle of suspicion had initially moved towards 45-year-old Hemraj, who had gone missing but his body was recovered from the terrace of the house a day later.

# The dentist couple is likely to walk out of the Dasna jail by Friday. The CBI court said they had killed Aarushi in a fit of rage because they suspected her of having an affair with Hemraj.

Pinaki Mishra, the lawyer who appeared for the couple in the Supreme Court, said the CBI will have no case to argue in the Supreme Court.




The Talwars then approached the Allahabad High Court, challenging this order. However, CBI named Rajesh Talwar as the prime suspect while giving a clean chit to Krishna and two other domestic helps who were also arrested in the case.

Her successful middle-class parents told police they were asleep in the next room when the murder was committed. Police said, Rajesh Talwar had murdered both the daughter and the helper seeing them in an undesired position.

The Talwars had challenged the CBI court's verdict in the Allahabad High Court, following which the division bench had reserved judgment a month ago. Both are in Dasna jail now.

On the night of May 15-16, 2008, Aarushi, eight days short of her 14th birthday, was found dead in her bedroom, with her throat slit, in the Talwars' Jalvayu Vihar residence in the Delhi suburb of Noida. The CBI has failed to prove beyond reasonable doubt the guilt, the court also held. The police was accused by many for not doing their investigation properly and they were even accused of tempering the evidences.

In 2009, the CBI handed over the investigation to a new team, which recommended closing the case due to critical gaps in investigation. It, however, added that there was insufficient evidence against them.
