Therefore in the hearing of the matter, the court urged to make a balance between both the conditions that is the Human Rights and National Security.

"We can not be oblivious to the plight of children and women", the Supreme Court said, adding that it has to strike a balance between human rights and national security.

Attorney Prashant Bhushan said the court had been expected to issue its ruling Friday, but delayed the decision until November 21, saying it wants more time to hear a petition on behalf of his clients, two Rohingya challenging the government's deportation plans.

Last month, the government had filed an affidavit in the apex court in which it said that Rohingyas are illegal immigrants and pose a threat to the national security.

However, it also allowed petitioners to approach it in case of any contingency.

'We have to strike a balance.




Earlier, the apex court had said that it will hear the petition filed by Rohingya Muslims challenging the government's stand to deport them back to Myanmar on Friday. It is not an ordinary case.

The apex court earlier asked Centre and two Rohingya Muslims, who have challenged to deport refugees to Myanmar, to desist from making emotional arguments and personal attacks and to file documents, including worldwide conventions.

At Friday's hearing, the Supreme Court appeared inclined to accept the petitioner's request to order the centre to put the deportation plan on hold.

"India's justification to deport the Rohingyas to Myanmar is premised on the false assumption that all of them present a potential threat to national security". The Indian government is seeking to deport them, saying some of them may be linked to militant groups based outside of the country.

In their petition, the two Rohingya immigrants, Mohammad Salimullah and Mohammad Shaqir, argued that they had taken refuge in India after escaping from Myanmar due to widespread discrimination, violence and bloodshed against the community there.

Almost 15,000 have received refugee documentation, according to the United Nations, but India wants to deport them all. The immigrants also challenged their deportation on grounds of violation of global human rights conventions.
