Supreme Court to deliver verdict on women entering Kerala's Sabarimala temple today

It was expected that the apex court is likely to announce the verdict today on whether women can enter the Sabarimala Temple.

On Friday, the Supreme Court is likely to pronounce its landmark verdict on the entry of woman into Kerala's Sabarimala Temple. Earlier this year in February, the apex court reserved an order while referring the case to a Constitution bench.

The management of the temple had stated that ban on entry of women was because they can not maintain "purity" on account of menstruation. The temple is located on a hilltop in the Western ghats of Pathanamthitta district.

The larger Bench will choose whether the restriction on ladies to enter the sanctuary qualifies as a "essential religious practice" of the Hindu faith over which the summit court has no ward. It said that this can not be done under the Constitution. Article 15 of the Constitution places a clear constitutional obligation on the state to not discriminate against any citizen on grounds of religion, race, caste, sex, place of birth. You can not refuse entry to a woman who comes there. It recently held that the practice of divorcing a woman by chanting "talaq, talaq, talaq" was illegal as it violated Muslim women's fundamental rights. We understand the seriousness of issue. The Sabarimala temple restricts women aged between 10 to 50 years from taking the journey to Sabarimala - which implies women are prohibited from making the hard trek to the place of worship. "Every right needs to be balanced but every balancing has its own limitations..."




Women's rights activists have high hopes from the apex court. Talking to ANI, women activist Brinda Adige said, "Since last couple of months, we have been seeing that the Supreme Court is bringing out several progressive and landmark judgments". I am hoping that tomorrow also entry of women in Sabarimala would be positive.

Earlier in 2016, citing the Constitution, the Supreme Court had questioned the ban, saying that this can not be done under Constitution.

As was usual for Buddhist monasteries in the middle ages, women were not allowed admission to a place inhabited exclusively by celibate monks.
