Ezekiel Elliott's suspension blocked again in NY court

Elliott's request for a recall of the mandate by the Fifth Circuit Court of Appeals, throwing out the preliminary injunction that was blocking a six-game suspension for violating the NFL's personal conduct policy, was rejected Tuesday morning. The ruling means that the Cowboys running back can play against the San Francisco 49ers on Sunday.

Last Thursday, the panel ruled 2-1 in the NFL's favor, granting the league's emergency request to set aside an injunction and ordered a district court in Texas to dismiss Elliott's case.

Judge Paul Crotty said he first wants to review a similar case involving New England Patriots' quarterback Tom Brady, who was ordered by a Manhattan federal appeals court a year ago to begin a four-game suspension amid objections from the NFL Players Association. In New York, his legal team is trying again to get an injunction that would stop his six-game suspension.




But the NFL's lawyers accused Elliott of trying to "manipulate" the process. Police dropped criminal charges after it was determined there wasn't enough evidence, but Elliott was still liable to be punished by the NFL.

But Elliott was granted a hearing by Southern District Court of NY today on his motion for a new temporary restraining order or preliminary injunction. The NFL Players' Associated sued in federal court on behalf of Elliott, saying the appeal hearing was "fundamentally unfair" because the running back was prevented from confronting his accuser in the OH case. Brady won a preliminary ruling from a federal judge, just as Elliott did, before losing on appeal.
