The fate of a number of MPs could be decided by what the High Court considers to be "all reasonable steps" to renounce citizenship of another country.

If the resolution is successful, the nine MPs would be referred to the High Court to determine their eligibility to sit in parliament.

Nick Xenophon Team's Rebekha Sharkie did not receive her confirmation of renunciation in time.

Ms Gallagher has always been under a cloud, having not received confirmation she'd renounced her United Kingdom citizenship.

She told parliament on Wednesday she stood by her advice that she was eligible for parliament as she had take all steps required to renounce her British ties.

He said there was no doubt that the Labor MPs had dual citizenship at the time of the 2016 election.

'I have further sought legal advice ... to confirm my citizenship status exclusively as an Australian citizen, ' he wrote, despite marking a box declaring he had never been a citizen of any country other than Australia.

This could mean they not in the clear, as Mr Turnbull gave his MPs weeks to prepare the needed documents, The Sydney Morning Herald reported. She has not provided conclusive documentation despite claiming her husband lost his Italian citizenship when he naturalised as an Australian in 1958.
