Max case: kin take baby's body, perform last rites

But to their utter horror, the the boy was still alive, while they were on way to do their final rites. PTI reported that the child's father, Ashok Kumar, has refused to accept the body as a mark of protest.

The hospital had sacked two doctors involved in the case but has said its internal investigation was not complete yet. The baby, meanwhile, remains critical at a nursing home in Pitampura.

Parents of a twin born prematurely at Max hospital Shalimar Bagh alleged that the hospital declared one of them dead when the baby still had signs of life.

Delhi's police in their statement said that it had transferred the case to its crime unit.

The parents say they discovered their baby breathing inside a plastic bag he was placed inside of while en route to a crematorium in the Indian capital of New Delhi.

The parents said the baby was alive while on their way to his funeral.

The baby's mother had given birth to twins, a boy and a girl, but the girl had been stillborn, according to CNN. The family has been demanding the arrest of the doctors allegedly responsible for the negligence. While we understand that survival in extreme preterm births is rare, it is always painful for the parents and family.

"We wish to clarify that this action should not presuppose finding of any lapse by the expert group and should not be construed in any way to be anything other than an expression of our continued commitment to providing quality healthcare", said Max Healthcare in a statement.

Malik's family had reportedly asked for financial assistance from the government to move the newborn to a "bigger and better" hospital than India's Delhi New Born Center, where the baby was being treated. He also said he will also not get his wife, who is still admitted at Max Hospital, discharged from it, until they get justice.

A panel formed on Monday by the Delhi government to look into the recent case has found the hospital guilty of not following prescribed medical norms in dealing with newborn infants. Health Minister Satyendar Jain ordered a probe on December 1.
