New Jersey man stripped of his USA citizenship

Baljinder Singh, 43, from the town of Carteret in New Jersey, became a naturalised USA citizen in 2006 after marrying an American woman.

Singh, a 43-year-old resident of Carteret, New Jersey, had married a US citizen and received citizenship in 2006.

Efforts to reach Singh for comment were not immediately successful.

Baljinder Singh, also known as Davinder Singh, is the first casualty of "Operation Janus", a joint operation by the DOJ and U.S. Citizenship and Immigration Services (USCIS).

In 2016, the Homeland Security Department's inspector general reported that the USA government had mistakenly granted citizenship to at least 858 foreign nationals who were ordered deported and later used different names and birthdates to apply for citizenship. On Friday, a federal judge in New Jersey stripped him of his naturalisation reducing his living status to a lawful permanent resident.

"The Justice Department will continue to use every tool to protect the integrity of our nation's immigration system, including the use of civil denaturalization", Readler added.

This is the first case under a government initiative which is created to clamp down on fraudulent immigration, reported AFP. Those cases include background checks that were used in the naturalization process, officials said. All three cases were part of Operation Janus.




USCIS dedicated a team to review these Operation Janus cases, and the agency has stated its intention to refer approximately an additional 1,600 for prosecution.

Under U.S. law, naturalization can be revoked only if it was obtained fraudulently.

In 1991, Singh landed at the San Francisco Airport without any travel documents or ID.

The Department of Justice, which moved a petition in this regard before a USA court last September, said that Singh in his citizenship application concealed prior orders of exclusion and his deportation under different identities than the identity under which they naturalised.

Singh is accused of illegal procurement of naturalization by not being lawfully admitted for permanent residence, illegal procurement of naturalization due to lack of good moral characters, and procurement of US citizenship with concealment of a material fact or willful misrepresentation, it said (see India-West article here). After allegedly failing to appear for his immigration hearing, he was ordered deported in January 1992.

Reportedly, the first Indian to face such an action, the authorities believe that the former Indian citizen Baljinder Singh alias Davinder Singh entered United States by marrying a U.S. citizen and then later, acquired American citizenship through fraudulent means. His status has now been reverted to be a green card holder and that makes him open to deportation based on the Department of Homeland Security's discretion, the Justice Department said.
