'Liver branding' surgeon Simon Bramhall avoids jail, gets fine, community service

The argon beam machine he used to burn his initials is typically used to stop bleeding during surgery, or to mark the area for operation. The marks left by argon do not impair the liver's function and disappear by themselves.

One of Bramhall's branded patients, an unnamed woman, wrote a victim impact statement shared during the sentencing hearing, The Mirror reports.

He pled not guilty to more severe charges of assault causing bodily harm, and prosecutors accepted it. A photograph of the 4cm-high branding was taken on a mobile phone.

Bramhall resigned from his position at the hospital in the summer of 2014, while the investigation was still ongoing, but he was still allowed to practice.

Birmingham Crown Court was told one of the victims suffered serious psychological harm as a result of the branding, while the other was traced through hospital records but "did not wish to engage" with police.

"What you did was an abuse of power and a betrayal of trust that these patients had invested in you".

The eminent doctor described as one of the leading surgeon's in his medical field appeared for sentencing at Birmingham Crown Court on January 12 after he admitted two charges of assault at an earlier court appearance, claiming his actions were created to relieve tension during surgery.

The liver was salvaged from the plane and Bramhall successfully transplanted the liver into the patient and saved the patients life.




Judge Paul Farrer QC also sentenced Bramhall on Friday to a 12-month community order with 120 hours of unpaid work.

A leading British liver surgeon has been spared jail after he admitted branding his initials onto the livers of two patients.

"It was what I would imagine the feeling is for someone who is a victim of rape", she said.

The University Hospitals Birmingham NHS Foundation Trust said: "The Trust is clear that Mr Bramhall made a mistake in the context of a complex clinical situation and this has been dealt with via the appropriate authorities, including the Trust as his then employer".

Medical experts have said that the "burning" of organs would not have caused damage to their health or affected clinicial outcomes for patients.

"Both of the operations were long and hard".

"I accept that on both occasions you were exhausted and stressed and I accept that this may have affected your judgment", the judge continued.

He said: "I accept that on both occasions you were exhausted and stressed and I accept that this may have affected your judgement.This was conduct born of professional arrogance of such magnitude that it strayed into criminal behaviour".
