'Public nonplussed' by rulings on care for Alfie Evans, court told

They want to move Alfie to a hospital in Rome and say doctors there are willing to treat the little boy.

Barrister Paul Diamond said on Monday that there was a "passion out there" about Alfie Evans' case.

The parents have also lost fights in the High Court, Court of Appeal, Supreme Court and European Court of Human Rights.

"As has been determined with considerable clarity in this case, Alfie's best interests are determinative and the court has decided what treatment he should or should not receive".

"There is a passion out there", Mr Diamond told appeal judge Lord Justice Davis, Lady Justice King and Lord Justice Moylan. They wanted to take him to Italy for medical treatment.

"We fully understand what a sensitive and emotional time this is for everyone involved and I would also therefore like to pass on our appreciation for the way in which Alfie's family were later able to speak to the crowd and offer assurance and calm".

Alfie Evans, from Liverpool, is on a life support machine and requires round-the-clock treatment at Alder Hey Children's Hospital in the city.

Justice Moylan denied permission to appeal to the Supreme Court.




In February, Mr. Justice Hayden of the High Court ruled that whatever was causing Alfie's condition, the damage to the toddler's brain was so severe that it was in his best interest to be taken off life support.

In a statement, Alder Hey Children's Hospital said it trusted that "the public and supporters of Alfie's parents will read in detail the decision of the Court of Appeal following today's hearing".

According to weekend news reports, Alfie Evans' mother was told to leave his bedside after the hospital informed Alfie's parents that they would no longer be able to sleep in his hospital room overnight.

Alfie's parents say "the state" is wrongly interfering with their parental choice.

During the December 2017 inspection, safety watchdog Care Quality Commission found "very worrying problems" in its operating theatres, "near misses" that went unreported, and there were complaints from theatre staff that hospital managers did not listen to their "repeated concerns".

That hearing came after Alfie's parents failed to reach an agreement with Alder Hey bosses about their son's end of life plan.

However, Alder Hey said in a statement: "Noise from recent protests has unfortunately affected our patients so we would ask that noise levels outside the hospital are kept to a minimum and, for example, vehicle horns are not sounded".

Some hospital visitors described the protest as "a circus" and said there was a bouncy castle, people drinking alcohol, and "children running everywhere" as 100 supporters gathered outside on Sunday night.
