Senator Omo-Agege absent from Tuesday sitting

The Senate says it will comply with the Federal High Court' judgment setting aside its suspension of Senator Ovie Omo-Agege.

Dimgba said that the reason given by the Senate and the Senate President for suspending Omo-Agege was unconstitutional.

His suspension was based on is comment that amendment to section 25 of the Electoral Act, 2010 (as amended), bordering on reordering of elections sequence was targeted at President Muhammadu Buhari.

"We have equally filed an appeal against the judgement of the court and a motion for stay of execution of the judgement at the Court of Appeal".

The judge also added that the Senate's decision to punish Omo-Agege for filing a suit against the Senate and for punishing him while his suit was pending constituted an affront on the judiciary.

Justice Nnamdi Dimgba of the Abuja Division of the Federal High Court in a pronouncement last week Thursday said the Senate's decision regarding the suspension, as well as the pattern adopted by the National Assembly, was constitutionally defective.




Mr Omo-Agege in reaction on Monday said the appeal will not hinder his resumption as the stay of execution which the Senate applied for has not been granted.

The joint Senate and House of Representatives ad hoc committee investigating the invasion of the Senate's chamber and the snatching of its mace has invited Ovie Omo-Agege and Ali Ndume.

Late Monday night, the Senate released a statement, clearing the way for Omo-Agege to resume.

Omo-Agege was suspended over his comment allegedly tarnishing the image of the senate. He said that since the Senate had filed an appeal against the judgment, it would wait for the outcome of the appeal before taking action.

Okowa made the pledge at the weekend in Asaba, the state capital during a meeting with stakeholders in the Delta North Senatorial district.The assurance became necessary following allegations that the PDP imposed some candidates and rigged the contest in favour of some candidates.The Chairman of PDP in the district, Mr. Moses Iduh commended the governor for the successful conduct of the Ekiti PDP governorship primaries.

According to him, "I'm of the view and will insist that the senate should respect the court order given in respect of the suspended Senator, to set a standard for respect for rule of Law;And to challenge the executives & all security agencies to also respect all court orders pending before them". Dino Melaye (Kogi-APC) on the matter.
