Rebel Wilson's record-breaking £2.7m defamation payout slashed to £340,000

Rebel Wilson's record-breaking £2.7m defamation payout slashed to £340,000

Rebel Wilson's record $4.5m damages win for defamation by Bauer Media has been reduced to just $600,000 on appeal.

The actress is now filming in Europe, and ahead of the decision, took to Twitter last night to say that regardless of the level of payout, she had won the case.

In court a year ago, she successfully argued that eight articles published by Bauer magazines in 2015 had portrayed her as a serial liar, and that this resulted in her being sacked from two feature films.

Supreme Court Justice John Dixon awarded her a record $4.5 million, including $3.9 million in economic damages relating to a loss of income.

"For a considerable number of reasons, the critical inferences drawn by the judge could not be upheld", three judges in the Victorian state appeals court wrote in a judgment.

Wilson's lawyers had argued she missed out on film roles between mid-2015 and the end of 2016 due to the "grapevine effect" the articles had within the film industry.

During the case, Wilson said the articles had alleged that she lied about her name, age and upbringing in Australia.

But the Court of Appeal found there was no basis for her to be awarded financial damages for the potential loss of roles, setting aside the economic damages entirely.

"I'm away on location in Europe filming right now", she tweeted.

The Court of Appeal is yet to determine costs.

Speaking on behalf of Bauer Media, General Counsel, Adrian Goss, said in a statement: "It was important for us to revisit the award of damages".

With defamation payouts capped in Australia at $350,000, University of Melbourne Law Professor Andrew Kenyon told 9news.com.au when news broke of the damages ruling this payout is "way higher" than Australia has ever seen.

The Sydney-born actress is now busy filming her new movie Jojo Rabbit in Europe.

Wilson won the largest defamation payout in Australian history in September 2017, after Woman's Day Magazine accused her of being a serial lair.
