Justice Kennedy to retire from Supreme Court

Timing is the issue, Coon said, adding that it's important for Senate Republicans to finish the nomination process prior to the November 6 general election. Senate Majority Leader Mitch McConnell said the Senate "will vote to confirm Justice Kennedy's successor this fall".

Indeed, a similar scenario played out in 2016 and, two years later, the strategy is proving successful for Republicans.

Calling Justice Kennedy a "great justice" who has displayed "tremendous vision and heart", Trump said a search for his successor will start "immediately". He said the voices of millions of Americans heading to the polls this fall "deserve to be heard".

Dean Heller sent out a fundraising appeal roughly an hour after the news broke, declaring that he alone could stop Democrats from taking the Senate and determining the next Supreme Court justice.

Trump says in the Oval Office that he hasn't "really thought about that".

Or Trump could go with a more renegade and overtly political pick, such as Sen. After that the court will have only eight justices and an ostensible 4-4 deadlock, as it did from February 2016-April 2017 after Antonin Scalia's death.

McConnell ended up holding the seat open for more than a year, until after Trump won the election and Neil Gorsuch was confirmed to take Scalia's place.

But for Republicans who have feared a massive enthusiasm advantage for Democrats, the sudden vacancy that could shape the court's direction for a generation was nothing short of a gift from the political gods.

As many conservatives saw it, Justice Anthony Kennedy's 1988 ascent to the nation's highest bench was reason for only muted celebration, if any, because he settled into the seat that his nominator, President Ronald Reagan, had first tried to fill with the conservatives' favorite jurist, Robert Bork. "Heidi will vote "no" for any pick we make for the Supreme Court", Trump said.

"I think it's inappropriate to discuss", he added.

De Sousa said he understood the significance because of his background as a constitutional lawyer.

Says the Kentucky Republican, "It's imperative that the president's nominee be considered fairly and not subjected to personal attacks".

Justice Anthony Kennedy's retirement will let President Trump drastically reshape the Supreme Court, and the absence of his crucial swing vote may usher in major changes in the legal landscape on a number of key issues.

The president, who had compiled a list of 25 candidates since his campaign, said he may interview one or two candidates this weekend at his resort in Bedminster.

The president's standing with white evangelical Christians hit an all-time high in April when 75 percent of evangelicals held a favorable view of Trump, according to a poll conducted by the Public Religion Research Institute.

Kennedy has always been considered the swing vote on the court between the liberal and conservative justices.

Sen. Jon Tester of Montana, who is up for re-election as a Democrat in a state that voted for Trump, thanked Kennedy for his service. Religious conservatives will consider this Providential and will, for perhaps the first time, thank God for Kennedy.

At the same time, Kennedy wrote the Citizens United decision in 2010 that upended campaign finance restrictions and was a fifth vote in landmark cases granting gun rights and striking down part of the Voting Rights Act. Kavanaugh also served as a law clerk to Kennedy of the Supreme Court.

Kavanaugh is a longtime Washington insider, also a onetime Kennedy clerk and a key member of independent counsel Kenneth Starr's team that produced the report that served as the basis for President Bill Clinton's impeachment.

"Conservatives generally know what to expect when it comes to Trump's judicial appointees, and thus far he's delivered for them". Susan Collins said that she sees Roe v. Wade, the landmark case that legalized abortion across the USA, as "settled law".
