Conservatives Ready Their War Chests For Major Supreme Court Fight - Katie Pavlich

The 53-year-old Cavanaugh is now a judge on the U.S. Court of Appeals for the District of Columbia, and previously served under President George W. Bush's administration as staff secretary to the office of the president. She is a well-known conservative whose past comments on abortion drew attention at her Senate confirmation hearing.

Here are five facts about Kavanaugh.

Kavanaugh, 53, took part in investigations of former President Bill Clinton, helped former President George W. Bush prevail in the 2000 Florida vote recount battle, and served in the Bush administration before Bush nominated him to the federal bench.

Hardiman is a "late addition" to Trump's final four, per the New York Times, but he was the runner-up to Justice Neil Gorsuch previous year.

"The indictment and trial of a sitting President, moreover, would cripple the federal government, rendering it unable to function with credibility in either the global or domestic arenas", Kavanaugh wrote in a 2012 piece titled "Separation of Powers During the FortyFourth Presidency and Beyond" for the Minnesota Law Review. Plus, he is a former law clerk to Kennedy, who switched sides quite a bit during his time on the Supreme Court. Judges are not supposed to re-write the law, re-invent the Constitution, or substitute their own opinions for the will of the people expressed through their laws.

The real players are folks like Senate Majority Leader Mitch McConnell, whose late-hour political jockeying upended the notion that the high court spot was D.C. Circuit Court of Appeals Judge Brett Kavanaugh's to lose. "We have every confidence that, as members of the Senate come to know and appreciate Judge Brett Kavanaugh. that we'll see him confirmed".

What Could Complicate Kavanaugh's Nomination? While he has yet to reveal his sentiments on the 1973 Supreme Court decision that established a constitutional right to abortion access, he was involved with a dispute over whether a pregnant migrant woman who was being held by immigration authorities could receive an abortion in 2017, according to the Los Angeles Times.

Senator Dianne Feinstein said Trump's choice "could have a bigger effect on Americans' daily lives than any justice in our lifetime".

McConnell also said he expects Senate Democrats to grill Kavanaugh on decisions he might make, which he characterized as atypical for the confirmation process.

Another Democrat, Senator Richard Blumenthal, on Sunday assailed Trump's reliance on a list of potential nominees endorsed by the conservative Federalist Society.

Trump ran firmly against Obamacare and has since tried to tear it down.

Barrett - a longtime Notre Dame Law School professor who became a federal appeals judge last fall - excited social conservatives with her testimony when she was questioned about her Roman Catholic faith in her nomination hearings previous year.

In his dissent for Seven-Sky v. Holder, Kavanaugh detailed how he views the role federal courts should play, one that includes no oversight over Congress's taxation powers. "Over the coming weeks I will review his judicial record while also ensuring that Judge Kavanaugh will approach each case on its merits and follow the law as it is written".

In the coming year the court might have to consider Trump's powers and rights in the investigation into links between his presidential campaign and Russian Federation, and whether he sought to obstruct that investigation.

Republicans occupy 51 Senate seats.
