Trump DOJ appealing judge’s OK of AT&T-Time Warner merger

The Justice Department's appeal is lodged with the U.S. Court of Appeals for the District of Columbia Circuit, a step up from the federal district court where the six-week trial unfolded in the spring.

The US Department of Justice (DoJ) has been involved in a long-running battle to stop the takeover, which it argues will result in higher prices and less competition. Were he to grant a stay during the appeals process, the merger would not have been completed before the June 21 "break-up date" for the deal.

AT&T told PCMag it was "surprised" by the move. The Justice Department still had 60 days, however, to appeal the decision approving the merger.

Delrahim and DOJ-Antitrust's suit against the AT&T-Time Warner merger bucked this trend, seeking to establish a norm against some vertical integration in the era of tech giants that increasingly offer products up and down the supply chain. AT&T is one of the country's biggest telecommunications providers, and its purchase of Time Warner allowed it to pick up some of the biggest media brands in the United States, including HBO and CNN.




On Thursday, AT&T said: "The court's decision could hardly have been more thorough, fact-based and well researched". In his ruling, he said the government had failed to show competitive harm.

As a candidate for president, Donald Trump said he opposed the deal, say it would be "too much concentration of power in the hands of too few".

Some legal experts believe it would be hard for the government to convince an appeals court to overturn Judge Leon's ruling.

At the time of his ruling, the judge wrote that he did not believe "the government has a likelihood of success on the merits of an appeal" were it to consider one. AT&T said it was prepared to defend the case on appeal. It will also set a precedent for companies planning to make similar deals, such as Fox and Disney. Dt Investment Partners Llc acquired 9,320 shares as At&T Inc (T)'s stock declined 13.21%.
