Missing production forecasts is not uncommon but the regulators are investigating whether Tesla's were deliberately misleading. "Costs $35k after federal and state tax rebates in California, but true cost of ownership is closer to $31k after gas savings", Tesla CEO Elon Musk wrote on Twitter.

"The SEC has issued subpoenas to Tesla in connection with. certain projections that we made for Model 3 production rates during 2017 and other public statements relating to Model 3 production".

Musk said in that same earnings call that the company was struggling with "bottlenecks" on the highly automated Model 3 assembly line.

This feature will be rolled out in the next six weeks and supported by all the cars manufactured by the company in the last two years, including the lower-priced Tesla Model 3. The company made only just 2425 in the entire fourth quarter. It didn't hit the 5,000-a-week target until June 2018. Messages were left Friday seeking comment from the SEC and the Justice Department.




But now Tesla seems to finally be taking a step toward the vision the company first laid out in 2016.

The electric vehicle marker said: "Should the government decide to pursue an enforcement action, there exists the possibility of a material adverse impact on our business, results of operation, prospects, cash flows, and financial position".

Elsewhere in the interview, when asked about the killing of journalist Jamal Khashoggi by the very same Saudi regime that invests heavily in Tesla, Musk said that he would likely not accept its money moving forward, but stopped short of condemning the regime outright.

"We believe that the claims are without merit and intend to defend against this lawsuit vigorously", the company said in its filing.
