"If at some point after restoring the hard pass the government would like to move to vacate the restraining order on the grounds that it has fulfilled its due process obligations then it may, of course, do so and I will promptly address that and then the remaining basis of the (temporary restraining order)", U.S. District Judge Timothy J. Kelly said.

CNN had asked the judge to force the White House to return the credentials that give Acosta, CNN's chief White House correspondent, access to the White House complex for press briefings and other events.

White House press secretary Sarah Huckabee Sanders dismissed the legal action as "just more grandstanding from CNN", adding that "the White House can not run an orderly and fair press conference when the reporter acts [as Acosta did], which is neither appropriate nor professional".

The Trump administration argued that the president has broad discretion to strip any reporter of White House press credentials if he wishes.

Fox News, CBS News, and other media outlets have signed onto an amicus brief in support of CNN and Acosta.

After Acosta had asked his first question, Trump attempted to stop the journalist from asking a follow-up, and a White House intern stepped in to take the microphone away from Acosta, to no avail.

The Washington Post, The New York Times, NBC News and The Associated Press also backed CNN's lawsuit. The judge said Acosta's credentials would be returned immediately and reactivated to allow him access to the White House.

Kelly said that CNN was likely to succeed on its claim that Acosta was not granted due process when his passed was pulled, but he cautioned that the ruling was limited and he was not yet making a determination on broader First Amendment concerns.

Outside the courtroom, Acosta spoke to reporters and thanked other journalists for their support in the case. "There's no First Amendment right".

"The White House has made very clear that they don't like the content of the reporting by CNN and Jim Acosta", Boutrous said. Boutrous also said that Acosta's alleged rudeness isn't the issue here.
