Ginsburg's Recovery Is 'On Track,' 'No Further Treatment Required'

The court has not yet offered a timetable on Ginsburg's return. The White House is reportedly reaching out to conservative activist groups in anticipation that Ginsburg may soon retire or worse due to her recent cancer diagnosis and treatment.

Ginsburg missed the court's oral arguments for three consecutive days this week, participating in cases using transcripts - a first in the justice's 25-year tenure on the bench.

Politico reported that the White House stirrings came in response to Ginsburg being out of the office.

Ginsburg, 85, had surgery in Manhattan on December 21 to remove two cancerous nodules from her left lung and was released on Christmas Day. "She's barely two weeks out", Dr. Raja Flores, chief of the division of thoracic surgery at Mount Sinai Hospital in NY, told CNBC.

Justice Ginsburg is now a three-time cancer survivor, and according to the American Lung Association, most patients are back to their usual lifestyles within a month after a lobectomy.




"Post-surgery evaluation indicates no evidence of remaining disease, and no further treatment is required", she said.

"They're doing it very quietly, of course, because the idea is not to be opportunistic, but just to be prepared so we aren't caught flat-footed", one anonymous source told Politico. If Ginsburg, who was appointed to the Supreme Court by former President Bill Clinton, were to vacate her seat, Trump would have the opportunity to give the Court its largest conservative majority in decades. That change was also needed to confirm Kavanaugh, who faced sexual misconduct allegations that necessitated additional testimony following his initial hearing.

Politico said numerous prospective nominees to replace Ginsburg were women, which theoretically would derail the likelihood of sexual-assault claims such as those faced by Justices Thomas and Kavanaugh.

Updated at 11:47 a.m.to add details about Ginsburg's diagnosis and plans for next week. 'I wouldn't say she's exactly on my side, but I wish her well, I hope she gets better, and I hope she serves on the Supreme Court for many years'.

She has otherwise said that she "will do this job as long as [she] can do it full steam".
