Sprint sues AT&T, claiming 'deceptive' and illegal 5GE branding

Sprint's response, however, is far more serious, as it's brought a lawsuit against AT&T with that 5G E branding at the center of it. The company has said the label reflects the fact that AT&T is on the pathway to rolling out a mainstream 5G network, which could eventually support download speeds up to 100 times faster than the current standard.

Sprint is requesting that the U.S. District Court for the Southern District of NY block AT&T from continuing to use the label "5G E" or any related variant of the label. AT&T has simply added some technology that can potentially deliver speeds slightly faster than LTE.

The four major carriers in the USA are all rushing headlong into 5G.

According to a report from Engadget, Sprint accuses AT&T of engaging in a "deceptive 5G E campaign" created to confuse and mislead customers into thinking they're enjoying true 5G support. Moreover, 43 recent of consumers believed if they were to purchase an AT&T phone today that it would provide 5G service.

"But calling its network "5GE" (or "5G E" or "5G Evolution") does not make it a 5G network and instead deceives customers into believing it is something that it is not", the suit said. "AT&T's deceptive ads have harmed consumers by persuading them to purchase or continue purchasing AT&T's services based on the lie that they are offering 5G", said Sprint to Android Authority.

AT&T's product is "nothing more than" advanced LTE, or an advanced version of what the industry calls 4G Long Term Evolution technology, according to the lawsuit filed in U.S. District Court in the Southern District of NY. We will fight this lawsuit while continuing to deploy 5G Evolution in addition to standards-based mobile 5G. "AT&T's "5G E" network is a 4G LTE Advanced network, just like the networks of Sprint and the other major wireless service providers, none of which are mischaracterizing their 4G LTE Advanced networks as 5G".

Sprint filed a federal lawsuit against AT&T on Thursday, claiming the telecom carrier is practicing a misleading marketing campaign around the fifth generation of mobile technology, or 5G. Carriers that are perceived to offer more advanced technology then stand to gain a "significant competitive advantage" over other companies. In December previous year, AT&T, the second-largest operator in the United States, announced that it had pushed the "5G E" icon to users. T-Mobile CEO John Legere was less restrained.

AT&T did respond to Sprint's lawsuit with a statement claiming that "our competitors don't like what we're doing, but our customers love it", because apparently AT&T customers can't get enough fake 5G service. "Sprint will have to reconcile its arguments to the FCC that it can not deploy a widespread 5G network without T-Mobile while simultaneously claiming in this suit to be launching 'legitimate 5G technology imminently.'" Sprint and T-Mobile are still awaiting the fate of their proposed merger.

AT&T issued its own statement that acknowledged a distinction between its 5GE service and "standards-based 5G" service. Engadget has the report on Friday, saying that Sprint is now suing AT&T for misleading its customers.
